Notice on the extension of time for applicants who have impacted by the COVID-19 in Vietnam

In compliance with the Prime Minister’s order, on March 31, 2020, the NOIP has just issued Notice No. 5277/TB-SHTT on the extension of time for applicants who have impacted by the COVID-19 and ways of communication between the NOIP and applicants. According to the said Notice, we have noted the following points:

1. Extension of time for applicants who had impacted by the COVID-19

- All deadlines for registration proceedings (i.e.: requests for priority rights, subsequent document submission, responses to NOIP’s Decisions/Notices, requests for annuity/renewal of protection titles, appeals, and payment of fees) between 30 March 2020 and 30 April 2020 will be automatically extended by 30 May 2020;

- With other situations, if the applicants are still detrimentally affected by the pandemic in proceeding with their applications and/or registrations, they can request for “force majeure” regulations pursuant to Articles 9.4, 9.5 of Circular No. 01/2007/TT-BKHCN as amended and supplemented by Circular No. 16/2016/TT-BKHCN.

2. PPH JPO-NOIP program

The PPH pilot program of this year (2020) between the NOIP and Japan Patent Office (JPO) will start from 04 May 2020, instead of 01 April 2020.

3. Communication between the NOIP and applicants

Since 01 April 2020, all communication between the NOIP and the applicants will proceed via post or e-filing system.

In light of the above, regarding your filing instructions (for new applications), we shall try our best to proceed via the e-filing system. However, it may contain some delay as most of NOIP’s officers as well as bankers are working remotely.

In light of the current pandemic in Vietnam, and in order to ensure non-stop of our services, we note that most of our staff are working from home from 01 April to 15 April 2020. However, please rest assured that we will make great efforts to satisfy our valued clients’ instructions. Meanwhile, we wish all of our clients and colleagues, their families and friends to stay safe and healthy during these times.
