Vietnam to impose penalty on IP infringement in cyberspace, regulated by new Cybersecurity law

The alleged IP infringements discovered in cyberspace in Vietnam will be deemed as an act of violating the Article 18 of the Cybersecurity Law.

The violation together with appropriation of property, Internet-based organization of gambling, stealing Internet-based international telecommunication charges, violation of copyrights and other IP assets in cyberspace is regulated in Article 18 - Prevention and handling of uses of cyberspace, information technology or electronic means in violation of legislation on national security, public safety and order. However, the detailed penalty to be imposed or how to tackle if breaching the law is not yet mentioned and decided in this version of the decree.

The law also has many regulations on the acts of prohibiting illegal content that Internet users share or distribute if it infringes the legitimate rights and interests of other individuals and organizations.

Vietnam has recently released its draft Decree on the Cybersecurity law and is now opening for public consultation within 2 months before officially taking effect next year on Jan 1st, 2019. The Circular of the law providing specific guidelines is expected to be released soon in the coming time.
